Land clearing in Fallston usually means gently rolling farm ground with rich soil and woods grown up around it. The town covers about 2.2 square miles of northeast Cleveland County. Its 2020 census count was 627 people. Some large farm and wooded tracts remain around town, while new homes keep going in around them. Fallston grew where a north-south road out of Shelby toward Morganton met an east-west stagecoach route. That route ran between Lincolnton and Rutherfordton. The spot was first called Kitchen Corners, and its post office took the Fallston name in March 1886. Sheriff John Z. Falls, the town's namesake, built a store, a grist mill and a sawmill at the crossroads. The state incorporated the town in 1893. Its two-story 1927 brick store was listed on the National Register of Historic Places in 2019.
The middle of town sits on high ground at about 1,027 feet. USGS watershed maps put it right on the divide between the Buffalo Creek and First Broad River watersheds. Rain on one side runs to Buffalo Creek. Rain on the other side drains toward the First Broad. USGS stream maps show Buffalo Creek, Magness Creek and Long Branch within 3 miles of the crossroads. Farming still fits this ground, and hay led Cleveland County's crops by acreage in 2022, at 18,817 acres.
The rule to watch on an old Fallston farm tract is the one-acre line. NCDEQ says a job that will disturb more than one acre needs an erosion and sedimentation control plan. NCDEQ wants that plan submitted at least 30 days ahead of the first cut. A house pad, a drive off NC 18 or NC 182, and a yard can top an acre together. NCDEQ requires erosion control on smaller jobs too, whatever the size. On the Fallston divide, dirt that washes off a site heads for Buffalo Creek or the First Broad River.
NCDEQ treats farm land differently: land used to raise crops and livestock is generally exempt from the state sediment law. Timber harvesting on forest land is exempt too, as long as it follows the state's forestry water quality guidelines. Reclaiming a grown-up Fallston pasture for grazing or hay? Ask NCDEQ whether the exemption applies before work starts. At the estimate, we look at how much ground the job will disturb. Digging waits until NC 811 has had three full working days of notice, as state law requires.
You can, but check the permit rule first if the pile sits near a Fallston woodlot. The NC Forest Service requires one from midnight to 4 p.m. in or within 500 feet of woodland it protects. The permit is free online, or you can get one at a Forest Service county office. The Forest Service calls it a notice that a burn may happen. Permits can be canceled when fire danger is too high. A state burn ban stops all open burning, permit or not, and only natural vegetation may go on the pile.
Mulching and hauling skip the fire. The forestry mulcher leaves brush and saplings as a layer of mulch on the ground, so no burn pile forms. Logs and brush that have to leave go out on our grapple trucks as debris removal. Storm cleanup around Fallston works the same way. In February 2020, a tornado ran from west of Lawndale to northeast of Fallston and snapped or uprooted trees. An EF1 tornado in May 2024 snapped and uprooted trees as it passed south of town.
